Terms of Use

Welcome to Drive PB. These Terms of Use ("Terms") are a legal agreement between you and DrivePB, Inc. ("Drive PB," "we," "us," or "our"), covering your use of drivepb.com, the Drive PB tournament application, and any related pages, tools, or services (together, the "Platform").

Please read Section 16 (Assumption of Risk), Section 18 (Limitation of Liability), and Section 23 (Governing Law and Disputes) carefully. They limit your legal rights.

By creating an account, registering for an event, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Who we are

Drive PB is a software platform for organizing and registering for pickleball tournaments, leagues, and related events. Events listed on the Platform are operated either by us or by independent third-party organizers and host facilities ("Event Organizers"). Section 10 explains the difference and why it matters.

2. Eligibility

You must be at least 18 years old to create an account on the Platform.

Participants under 18 may be registered for an event only by a parent or legal guardian, who must create and maintain the account, agree to these Terms on the minor's behalf, and sign the applicable waiver and release. We do not knowingly permit anyone under 18 to create their own account.

We do not knowingly collect personal information from children under 13. See our Privacy Policy for details.

You are responsible for making sure your participation complies with any rules of your club, league, or governing body.

3. Your account

You agree to provide accurate, current, and complete information when you register, and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at info@drivepb.com if you believe your account has been compromised.

We may suspend or close any account that we reasonably believe contains false information, has been used to circumvent event rules, or has been used in violation of these Terms.

4. Event registration and entry fees

Registering for an event through the Platform creates a binding commitment to participate, subject to the refund terms below. Entry fees, deadlines, division requirements, roster limits, and other event-specific rules are listed on each event's page and are incorporated into these Terms by reference.

Registration is not confirmed until payment is completed and you receive a confirmation from us. Events and divisions may fill; registration may close early.

5. Refunds, withdrawals, and cancellations

Unless an event page states different refund terms, the following defaults apply:

  • More than 30 days before the event: full refund of entry fees, less any non-refundable processing or service charge disclosed at checkout.
  • Between 30 and 14 days before the event: 50% refund.
  • Fewer than 14 days before the event: no refund. You may, at our discretion, be permitted to substitute another eligible player of the same division level.
  • No-shows: no refund.
  • Medical or emergency withdrawals: handled case by case; contact info@drivepb.com with documentation.

If we cancel an event outright and do not reschedule it, we will refund entry fees, less any non-refundable processing fees already incurred. If an event is shortened, delayed, moved, or partially completed because of weather, facility conditions, low registration, public health orders, or other circumstances outside our reasonable control, refunds are at our discretion and may be partial or unavailable. Costs such as food, medals, court rental, and staffing are committed in advance.

We are not responsible for your travel, lodging, or other incidental expenses under any circumstances.

6. Divisions, ratings, and rosters

Events on the Platform may use DUPR ratings or other rating systems to set division eligibility. You agree to:

  • provide your accurate DUPR ID or rating, and not to misrepresent your skill level;
  • meet any age, rating, residency, or club-affiliation requirements stated for your division;
  • comply with roster deadlines, team-size limits, and substitution rules published for the event.

We and the Event Organizer reserve the right to verify ratings, move a player or team to a different division, or disqualify a player or team for misrepresentation of eligibility. Disqualification for misrepresentation does not entitle you to a refund.

Division rules, formats, and rating cutoffs may change before an event begins, including to balance pools or fill brackets. We will communicate material changes to affected players.

7. Event rules and conduct

By participating, you agree to follow the published rules of the event, the rules of the host facility, and applicable USA Pickleball rules where they apply.

You agree not to engage in: abusive, threatening, or harassing behavior toward players, officials, staff, volunteers, or spectators; cheating or deliberate misreporting of scores; damage to facility property; use of alcohol or controlled substances in a way that impairs safety or violates facility policy; or any unlawful conduct on site.

We and the Event Organizer may remove any person from an event for violating this section, without refund, and may bar them from future events.

8. Photography, video, and likeness

Tournaments are public events. By attending or participating, you grant us and the Event Organizer a non-exclusive, royalty-free, perpetual license to photograph and record you and to use your name, image, voice, likeness, club affiliation, and event results in promotional, editorial, and commercial materials, including social media, websites, sponsor materials, and event recaps, without further notice or compensation.

If you do not want to be featured in promotional content, email info@drivepb.com before the event and we will make reasonable efforts to accommodate you. We cannot guarantee exclusion from wide shots, live streams, or content captured by other attendees, media, or sponsors.

9. Public display of results and player information

Brackets, schedules, scores, standings, team rosters, club affiliations, and player names and ratings are displayed publicly on the Platform and may be shared with clubs, media, and rating systems including DUPR. Do not register if you are not comfortable with this.

10. Our role for third-party events

For events we do not operate ourselves, Drive PB acts as a technology and registration platform only. The Event Organizer is solely responsible for the conduct of the event, including scheduling, officiating, facilities, safety, prizes, and its own refund decisions. We are not a party to the agreement between you and that Event Organizer, and we do not control or guarantee their performance.

Disputes about a third-party event should be raised with the Event Organizer first. We will provide reasonable assistance in passing along registration and payment records.

11. Payments

Payments are processed by Stripe, Inc., a third-party payment provider. Your use of that service is subject to the processor's own terms and privacy policy. We do not receive or store your full payment card number.

You are responsible for any taxes applicable to your participation, and for any bank, currency, or card fees your issuer charges.

Chargebacks: if you dispute a charge with your card issuer instead of contacting us first, we may suspend your account and withhold future registrations until the dispute is resolved.

12. Prizes, medals, and awards

Prizes and awards are described on each event page and may change. Where prize value requires it, you are responsible for your own tax reporting. Sponsor-provided prizes are subject to the sponsor's own terms and availability, and we are not responsible for a sponsor's failure to deliver.

13. Your content

You may be able to submit content to the Platform, such as a profile photo, team name, or messages. You retain ownership of your content. You grant us a worldwide, non-exclusive, royalty-free license to host, display, and use that content to operate and promote the Platform and its events.

You agree not to submit content that is unlawful, infringing, obscene, defamatory, or that impersonates another person. We may remove any content at our discretion.

14. Our intellectual property

The Platform, including its software, design, text, graphics, logos, and the Drive PB and JOMG marks, is owned by us or our licensors and is protected by intellectual property laws. You may not copy, scrape, reverse engineer, resell, or create derivative works from the Platform, or use automated tools to access it, without our prior written permission.

15. Acceptable use and prohibited system conduct

You agree to use the Platform only for lawful purposes and in accordance with these Terms. Without limitation, you must not:

  • attempt to breach, probe, scan, or test the vulnerability of the Platform, our systems, or related networks, or to circumvent any security or access controls;
  • introduce or distribute viruses, malware, malicious code, or other harmful material;
  • send spam, unsolicited bulk messages, or abusive automated traffic through or to the Platform;
  • create multiple accounts, share accounts, or otherwise attempt to bypass event limits, registration caps, waitlists, payment requirements, or eligibility rules;
  • scrape, harvest, or use automated means to access the Platform except as expressly permitted in writing;
  • interfere with or disrupt the Platform, servers, or networks connected to it, or another user's use of the Platform.

We may suspend or terminate accounts and refuse registration for violations of this section, without refund where fees were paid in connection with the violation.

16. Assumption of risk and separate waiver

Pickleball involves inherent risks of physical injury, including serious injury, permanent disability, and death. These risks include but are not limited to falls, collisions with other players, contact with balls or paddles, court and facility conditions, heat and weather exposure, cardiac events, and the negligence of other participants.

You voluntarily assume all such risks. Before participating in an event, you will be required to sign a separate Waiver, Release, and Assumption of Risk agreement. That document governs your participation on site and controls over these Terms in the event of a conflict on those subjects.

You confirm that you are physically fit to participate and that you are responsible for your own health insurance and medical care.

17. Disclaimers

The Platform is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that schedules, ratings, brackets, or results shown on the Platform will be accurate or complete.

Without limiting the foregoing, you acknowledge that the Platform depends on internet connectivity, third-party services, devices, and local network conditions at event venues. To the maximum extent permitted by law, Drive PB is not liable for: system downtime or unavailability; delayed, missed, or failed emails, SMS, or push notifications; delayed or missing score, bracket, or schedule updates caused by poor cell service, Wi‑Fi, or other connectivity issues at courts or facilities; registration errors, slowdowns, or failures during peak sign-up periods; or any resulting missed deadlines, waitlist outcomes, or participation impacts. You are responsible for confirming critical information through the Platform when connectivity allows, or directly with the Event Organizer when needed.

18. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the Platform or any event, regardless of the theory of liability and even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to the Platform or an event will not exceed the greater of (a) the amount you paid us in entry fees for the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

19. Indemnification

You agree to indemnify, defend, and hold harmless DrivePB, Inc., its owners, officers, employees, contractors, volunteers, Event Organizers, host facilities, and sponsors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Platform, your participation in an event, your violation of these Terms, or your violation of the rights of another person.

20. Suspension and termination

We may suspend or terminate your access to the Platform at any time, with or without notice, for conduct we reasonably believe violates these Terms or is harmful to other users, Event Organizers, or us. You may close your account at any time by contacting info@drivepb.com. Sections 8, 9, 13–19, 21–24 survive termination.

21. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and provide reasonable notice, such as by email or an in-Platform notice. Changes apply prospectively. Your continued use of the Platform after changes take effect means you accept the revised Terms. The version of the Terms you accepted at the time of registration governs that registration.

22. Electronic communications and consent

By creating an account or providing contact information on the Platform, you consent to receive transactional and operational communications from Drive PB and Event Organizers at the email address, phone number, and other contact details you provide. These may include registration and payment confirmations, bracket and schedule updates, score alerts, waitlist notices, and emergency or weather-related schedule changes.

Message and data rates may apply for SMS. You may be able to opt out of non-essential marketing messages where offered; opting out of marketing does not affect transactional or operational messages needed to run your registration or event. Emergency and account-security related messages may still be sent as permitted by law.

23. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.

You and we agree that any dispute arising out of or relating to these Terms or the Platform will be brought exclusively in the state or federal courts located in Williamson County, Texas, and both parties consent to personal jurisdiction and venue there.

You and we agree that each may bring disputes against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The court may not preside over any form of class or representative proceeding.

24. Miscellaneous

If any provision of these Terms is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and any event-specific rules and waivers, are the entire agreement between you and us regarding the Platform.
